Estate Planning

Wills, Durable Powers of Attorney, Health Care Powers of Attorney, Living Wills/Advance Directives, Trusts (Revocable Living Trusts, Irrevocable Trusts, Irrevocable Life Insurance Trusts, and other Trusts)

An Estate Plan can give you peace of mind, knowing that everything and everyone is taken care of. With a durable power of attorney and health care proxy you can make your wishes known and have some control over your finances and health care in case you become incapacitated. If you have minor children or adult children who still need your care, you can name a guardian for them in a will and set up a trust to control the disbursement of their inheritance. Additionally, you can reduce probate costs and estate taxes with careful planning. We will work together with you and your financial and tax advisors to balance tax issues in your estate plan (particularly the estate tax (federal and state) and capital gains).

If you or a loved one has a disability or needs or will likely need long term care, we can help you incorporate planning for those issues in your estate plan. This may include planning for the cost of care and Medicaid eligibility with Irrevocable Trusts or a life estate or protecting the inheritance of a loved one with a disability with a Special or Supplemental Needs Trust. An ABLE 529A account is another important component of Specials Needs planning which this office can help you navigate.
